Crude Language Not Disorderly Conduct
Defendant lived in county, just across from city limits. A private company was staging a Christmas concert featuring a live outdoor “mariachi” band. Defendant called 911 to complain about the noise. The responding deputy arrested defendant because of his crude language. However, words used as a means of communication are protected speech under the First Amendment. No one, other than the deputy, heard the comments. Thus, no disorderly conduct.
