FCG was arrested on April 27, 2008. He immediately retained Jeffrey H. Garland on the charge.

The case fell into an ambiguous classification. The girlfriend initially reported FCG had "hit" her. Subsequent investigation established that this was not the entire story. The girlfriend claimed she never told the police she had been hit and did not want FCG arrested.

The State eventually elected to drop the charge on May 23, 2008.
